The UK adopts the EU-US Data Privacy Framework
The UK ICO has announced that from 12 October 2023, businesses in the UK can start to transfer personal data to US organisations certified to the “UK Extension to the EU-US Data Privacy Framework”.
Where the US data recipient hasn’t adopted the Framework, a contact mechanism will still be required to ensure that data exports to the US are lawful.
This is a complex area and due diligence should be adopted by UK organisations transferring data between the UK and the US. to ensure compliance with UK and US data privacy law.
Retained EU Law after Brexit - update
The Retained E.U. Law (Revocation and Reform) Act came into force in June this year. This did not create the wholesale scrapping of existing laws. However, it expected that some EU laws will be replaced.
The Government has published a schedule of EU law that will be revoked by 31 December 2023
